The study confronted, due to the bias of the bibliographic deductive methodology, two different proposals for legal formalization of Rights, a first strand of thought concerning the ideas of the generations or dimensions of rights defended by Karel Vasak, Arguing for the valuation and consideration of legal protection as a determinant factor in the emergence of rights, to the detriment of the ideas of Marcelo Neves in the perspective of symbolic legislation, confronting real materiality of legislations in the process Determination of rights. However, in the end, it does not declines by integral symbolization of legislation, but an effectiveness that, in which it is not refuted, unfolds by an excludent and reductive character of the aspect of the universality of fundamental rights.
