Abstract

The right to sustainable national development has influenced Brazilian law that is creating mechanisms for their implementation. This article deals with the importance of observation of this fundamental right by the public administration, especially regarding the bidding procedures in order to verify the correct ways of applying and explaining the reasons for the inclusion of this purpose of promoting sustainable national development. The survey was conducted by literature survey with analysis of doctrines, legislation and publications on the subject. Seeks to verify how this purpose can be observed and what the consequences of not applying as positions on the matter of the Courts of Auditors and jurisprudence. Also, if the new purpose is bidding procedure has social relevance or is it just a utopian ideal of the legal system. Sustainable procurement is more a precaution before the economic market uncertainty, especially in regard to international relations, it is up to government to create national protection mechanisms, constituting true fundamental right. The laws and principles shall be applied effectively, there's no excuses if the public administrator enforce the law through ignorance, and this cannot assess what the purpose of sustainable national development when unobserved produces no consequences to society.
