THE SUPREME COURT AS A PENDULUM BETWEEN LAWFARE AND MILITANT DEMOCRACY: TWO SIDES OF THE SAME COIN?

Brazilian social formation, emphasizing the transpositions of the institutes of lawfare, judicial activism and militant democracy in the field of the Judiciary. A priori, the theological and international influence on the state structure was highlighted and how this became a reflection of the relations between the three powers of the Republic. The analysis includes the judicial and media performance in the maintenance of neoliberal and conservative interests, pointing to a moralization of law and fundamental rights. In addition, it was sought to understand the interaction that the Federal Supreme Court has with those institutes, analyzing their interaction in the face of the constitutional limits imposed by the 1988 Charter.
