TERRA, TRABALHO E AQUILOMBAMENTO: TRATAMENTO NORMATIVO E ENTRAVES À TITULAÇÃO DE TERRAS COM ENFOQUE NAS COMUNIDADES DO ESTADO DO TOCANTINS.

Abstract

The State of Tocantins has 36 communities recognized as remaining quilombo communities according to a report made available by the National Institute of Agrarian Reform - INCRA (2024). However, there is only one territory in the stage of delivery of the collective property title, which reveals and reaffirms the scenario of violation of the provisions of art. 68 of the ADCT of the CRFB/88. The work aims to research and analyze the legal situation in relation to land titling procedures and government mobilization, as well as the lack thereof, so that quilombola lands are duly regularized and delivered to the communities located in the state of Tocantins. In addition, it aims to collect data about quilombola communities located in the state and document them, given that much of what refers to the communities has been lost or has not even been instituted as formal documentation. Searches were made in judicial and administrative bodies for the construction of this work, requests for access to documents based on the Access to Information Law to INCRA in order to understand the situation of quilombola territories in the state. The method is divided into two parts: quantitative research, encompassing the collection of bibliographic and documentary data; and, subsequently, qualitative research, focusing on the analysis of quantified data, based on documentary research procedures. It can be concluded that, in general, traditional quilombola communities in the State of Tocantins are targets of rights violations. The obstacles in the titling process put the self-determination of quilombolas and also their security at risk.
