CITY STATUTE: (in)application in the legal Amazon

Abstract

The aim of this article was to propose debate and reflections on the City Statute, especially on the challenges of (in) application by municipalities in the legal Amazon. Due to the breadth of the theme, it was necessary to make a cut and highlight two points: the social function of property and urban land regularization; understanding them as points of greater relevance in this legislation. The qualitative methodology applied to the study started from the analysis of the Statute, highlighting issues such as: its long duration in the approval process, more than a decade, and the strategy of its forwarding to the Federal Senate, as it is not common for Bills to enter by this Legislative House, which ended up dismantling the opposing actions promoted by real estate entrepreneurs, who had been demanding actions to avoid its approval. With the study, it was possible to verify that the legislation did not reach, as it should have, the small municipalities, especially those with a population of less than twenty thousand inhabitants, since they are not obliged to prepare the Municipal Master Plan. This notorious fact contributed to the results found on the small advances made and the considerable (in)application of the instruments of the Statute in the legal Amazon.
