Abstract

The objective of this study is to develop an analysis of the importance of autonomy for career public advocate and demonstrate that the direct link to the executive ends up generating some professional identity crisis which sometimes results in the fact, the intent to exercise its role as public advocate, the server just not acting in defense of the federal entity (Federal, State, Federal District and Municipalities), but the political agent, a situation that brings harm and reflects directly and negatively front of the public Administration. Autonomy for Public Advocacy results in a strong and valued institution, which is essential to a democratic state. In turn, the "Law of Government," which revolves around the interests of managers, produces authoritarian and hostile environments, translating into an incompatible with the dictates imposed by the 1988 Constitution model a differentiation will be made between assignments the public Advocate and the private lawyer, a study of the current public profile barrister, with the delimitation of its assignments, an analysis of the importance of ensuring the autonomy career, the required decoupling the executive for the best performance of his mister by the public Administration and a brief check of the Project for a Constitutional Amendment No. 82/2007, which aims to amend the Constitution to explicitly declare the administrative and technical category of public lawyers autonomy, budget. The method of approach is deductive, through field research with the study of a case. To research legislation, papers, magazines and books about the topic will be used.
