Abstract

Este artigo aborda a "Antropologia do Direito" de Fernanda Pirie, professora de Oxford, destacando o conceito de legalism como uma abordagem inovadora para compreender o fenômeno jurídico. Pirie argumenta contra a simplificação do direito a funções específicas, propondo uma análise baseada na forma sobre a função. O artigo explora a evolução da Antropologia do Direito, desde Malinowski até os desafios contemporâneos, e destaca a necessidade de superar abordagens definicionais simplistas. Por fim, explora a forma pela qual o conceito de legalism é apresentado, isto é, como uma forma de pensamento e ação específica do direito, permitindo comparações entre culturas jurídicas. Concluo afirmando que Pirie também enfatiza a importância de examinar a história do pensamento jurídico, alertando contra análises excessivamente centradas no presente.

Rafael Tubone Magdaleno, Universidade Federal do Tocantins

Philosophy of Law Professor at the Federal University of Tocantins (UFT). Holds a Ph.D. in Philosophy and General Theory of Law from the University of São Paulo (USP). Holds a Master's degree in Law (2018) and a Bachelor's degree in Law (2015) from the Pontifical Catholic University of São Paulo (PUC-SP). Holds a Bachelor's degree in Philosophy (2019) from the University of São Paulo (USP). Specializes in Public and Tax Law. Holds an MBA in School Management. Completed an exchange period at UFR LL-PHI, Department of Philosophy, at Université Paris-Ouest/Nanterre-La Défense. Has experience in Law, Philosophy, and Theory of Law. Former Director of the Nove de Julho Faculty and served as coordinator of the Law Course, where also taught subjects such as Political Theory and the Constitution of the Brazilian State, Criminal Law - Theory of Crime, Constitutional Law, and Introduction to Legal Studies (ILS). Served as assistant professor in the General Theory of Law course at USP. Was a regional effective member of the special commission on Digital Law of OAB/SP (2019/2021). Is a member of the research group "System of Justice and State of Exception" at the Pontifical Catholic University of São Paulo (PUC-SP). Is a member of the research group "Philosophy of Law and Political Thought" at the Federal University of Paraíba (UFPB). Is an associated member of the Brazilian Association of Philosophy of Law and Sociology of Law (ABRAFI), Brazilian section of the International Association for Legal and Social Philosophy IVR. Is a member of ABJD - Brazilian Association of Jurists for Democracy.
