Abstract

This paper discusses the possibility of civil liability of parents who abandon their children affectively, this is a controversial and contentious issue in the doctrine and jurisprudence. Despite the favorable position of the majority doctrine, the courts in most of its decisions have not understood by the indemnity in case of . Due to the dichotomy of positions and in order to corroborate the view that parental emotional neglect and / or breast culminates in moral damages subject to indemnification, at first this paper will discuss the general theory of liability, then present the principles which should govern the relations of family and the duties legally imposed on the parents to their children, focusing on those inherent in the family Power. Finally, a thorough analysis of the assumptions necessary to configure the obligation of neglectful parents monetized repair the moral damage caused to their children, as well as the positioning of the Superior Court shall be effected on the subject.
