THE CONTRIBUTION OF THE AMICUS CURIAE IN THE DIRECT UNCONSTITUTIONALITY ACTION N. 3.239-DF ON THE TITLE OF QUILOMBOLA TERRITORIES

Abstract

Quilombola territorialities are the subject of frequent dispute in the Brazilian judiciary, with Direct Unconstitutionality Action no. 3229-DF, the legal action that defines the contours of quilombola territorial rights based on the discussion of the constitutionality of Decree 4,887/2003, which deals with regulating art. 68 of the Transitional Constitutional Provisions Act. Having been filed in 2004 and judged between 2012 and 2018, the action had the participation, as amicus curiae, of several governmental and non-governmental organizations who, based on their expertise and their socio-legal and political-economic realities, presented arguments in defense of both the constitutionality and the unconstitutionality of the decree under analysis. Thus, through quali-qualitative research and using analysis of documents and video records of the trial sessions of the aforementioned ADI, the present research aims to identify how the participation of these organizations occurred and systematize which arguments they presented, in order to understand the impact of the participation of these groups on the judgment carried out.
