CONSTRUÇÃO DE SABERES NO DIREITO:

A LINGUAGEM PARA A DOCÊNCIA

Resumo

Resumo: A construção do saber jurídico remete ao estudo da ciência, da linguagem e ações pedagógicas. Neste trabalho, busca-se analisar e compreender os fundamentos da construção do saber jurídico por meio da construção teórica dos fundamentos da ciência, da linguagem como ferramenta de ensino-aprendizagem para além das lides forenses, de modo a possibilitar a superação da compreensão dogmática do Direito posto, utilizando-se, para tanto, da revisão e análise da literatura especializada. Foi possível considerar que a abordagem do Direito nem sempre passa por um processo científico racional de modo a envolver as diversas complexidades do cotidiano, seja do Direito, seja da sociedade na qual atua, o que levou a concluir que, diante da prática e da teoria. Tal conhecimento necessita encontrar ressonância na ciência e no cotidiano social por meio do conhecimento pedagógico.

Abstract: The construction of legal knowledge refers to the study of science, language and pedagogical actions. In this paper, it seeks for analyzing and understanding the fundamental construction of legal knowledge through the theoretical construction on the base of science, language as teaching and learning tool, in addition to the forensic labors, to enable the overcoming of the dogmatic understanding of the law, therefore, it uses the review and analysis of the literature. It was possible considering that the right approach does not pass by a rational scientific process involving various complexities currently, it is the law, it is the society in which it operates, which it has led to the conclusion before the practice and theory. This knowledge needs to find resonance in science and the presently social life through the pedagogical knowledge.
